Retiree Benefits

Nortel’s Motion 1114 -  Motion for Entry of an Order Terminating Retiree Benefits and Approving a Settlement Proposal Pursuant to 11 U.S.C.§ 1114.

Retiree Settlement Motion

On December 31, 2012, the Nortel U.S. Debtors filed a Motion for Entry of an Order Approving Settlement Procedures and Subsequently a Settlement Agreement with the Official Committee of Retired Employees [D.I. 9224].

The Motion describes the agreement that Nortel and the Retiree Committee have reached that will resolve the Debtors’ motion to terminate retiree benefits, and related issues. The settlement will allow for Nortel’s termination of the Retiree Plans as of June 30, 20131, provide a payment to the Retiree Committee, and provide for the release of claims by Nortel and retirees, among other things.

On January 23, 2013, the court entered an order that set March 12, 2013, at 4:00 pm as the deadline to object to the settlement agreement and set April 2, 2013, as the hearing date to consider approving the settlement agreement.  The court also approved notice procedures by which the Debtors and the Retiree Committee will provide notice to interested parties about the settlement agreement.
